Council and AILA Follow Up with DHS Regarding a Functioning System of Discretionary Release from ICE Detention

The American Immigration Council and the American Immigration Lawyers Association (AILA), through their joint initiative the Immigration Justice Campaign followed up on their March 25, 2021 letter to the Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) regarding the need for a functioning universal system of receipt and adjudication of discretionary requests for release from ICE custody. The letter includes examples of unfair denials of requests for release at ICE facilities around the country. 

Government Response

On November 22, 2021, ICE Acting Director Tae D. Johnson replied to the Council and AILA's follow-up letter addressing ICE's systems and procedures for discretionary release.
